Withdrawal from the Contract

This is a courtesy translation. The Czech version is legally binding.

A consumer who has concluded a contract over the internet generally has the right to withdraw from it within 14 days without giving any reason (Section 1829 of the Civil Code (občanský zákoník)). For chilled foods, however, the law provides exceptions that apply to most of our product range — which is why we describe this in such detail.

When withdrawal is not possible

Under Section 1837 of the Civil Code, it is not possible to withdraw from a contract for the supply of:

• goods that are subject to rapid deterioration — this includes caviar, chilled roe, smoked and fresh fish and other chilled foods,
• goods in sealed packaging which, for reasons of health protection or hygiene, are not suitable for return once the consumer has broken the seal — that is, an opened tin or jar,
• goods which, after delivery, have been irreversibly mixed with other items.

In practice this means: for caviar and chilled foods, no right to return the goods within 14 days arises. This does not in any way affect your right to make a complaint about defective goods — see the Complaints Procedure.

When withdrawal is possible

For goods that are not subject to rapid deterioration and whose packaging you have not opened — for example accessories or shelf-stable tinned goods — you have 14 days from the day of receipt to withdraw without giving any reason.

How to withdraw

1. Within the 14-day period, send us an unambiguous notice of withdrawal — by e-mail to [email protected], or by post to the address of our registered office. You may use the form below, but you do not have to. The deadline is met if you send the notice on the last day of the period.
2. Send or hand over the goods to us no later than 14 days after withdrawal. The cost of returning the goods is borne by the buyer.
3. We will refund the money — including the delivery costs up to the amount of the cheapest delivery method we offer — within 14 days of withdrawal, but not before we have received the goods back or you have proven that you have sent them. We refund by the same method by which we received the payment, unless we agree otherwise.
4. The buyer is liable for any reduction in the value of the goods resulting from handling them in a way other than is necessary to become familiar with their nature and characteristics.
5. Loyalty points credited for the returned order will be deducted; points redeemed on that order will be returned to your account.

Withdrawal by the seller

The seller may withdraw from the contract if the goods are unavailable, if the price has not been paid by the due date stated in the payment request, or if there has been an obvious error in the price. In such a case, the seller will inform the buyer without delay and refund any payment already received in full.
