Terms and Conditions
This is a courtesy translation. The Czech version is legally binding.
These terms and conditions govern the sale of goods in the Kaviár Dům online shop at kaviardum.cz and form an integral part of every purchase contract concluded here.

2. The Buyer
A consumer is a natural person who buys outside the scope of their business activity. Provisions marked as consumer provisions apply only to consumers. A business customer is a buyer who states a Company ID (IČO) when ordering or otherwise indicates that they are buying in the course of their business activity; such a buyer is not entitled to withdraw from the contract within 14 days, and the statutory consumer provisions do not apply to them.
3. Order and Conclusion of the Contract
- The offer of goods in the shop is non-binding; the Seller is not obliged to conclude a purchase contract, in particular if the goods are not in stock or if there has been an obvious error in the price or description.
- The Buyer places goods in the basket, selects the delivery and payment method at checkout and fills in the contact and delivery details. Before submitting the order, the Buyer may at any time check and correct all entered details and the contents of the basket by returning to the previous step.
- By submitting the order, the Buyer makes a binding offer. The Seller promptly confirms the order by e-mail to the address given in the order; the purchase contract is concluded upon delivery of this confirmation.
- The contract is concluded in the Czech language. The Seller archives it in electronic form and makes it available to the Buyer upon request.
- The Buyer agrees to the use of means of distance communication; the Buyer bears the related costs (internet, telephone), which do not differ in any way from their standard rate.
4. Prices and Payment
- All prices are stated including VAT. The delivery price is stated separately and is added to the price of the goods.
- The price stated for the goods at the time the order is submitted applies. A later change of the price in the shop does not affect a contract already concluded.
- Goods may be paid for by bank transfer to the Seller's account.
- When paying by bank transfer, the Seller sends the Buyer a payment request with a QR code, account number and variable symbol. The payment request is not a tax document. The goods remain reserved for the Buyer until the due date of the payment request; if payment is not made within this period, the Seller is entitled to withdraw from the contract and release the reservation.
- The Seller issues the tax document (invoice) after payment and sends it to the Buyer electronically to the e-mail address provided; the Buyer agrees to this. The document is issued in the Czech language and in Czech crowns.
- The goods remain the property of the Seller until the purchase price has been paid in full.
5. Delivery of Goods
- The delivery methods, their prices and delivery times are stated on the Shipping and Payment page and are also displayed at checkout according to the postcode entered.
- The Seller supplies exclusively chilled foodstuffs and is responsible for maintaining the cold chain until the goods are handed over to the Buyer or to a carrier designated by the Buyer.
- If the consignment cannot be delivered for reasons on the Buyer's side (no one accepts it, incorrect address, consignment not collected), the Seller is entitled to claim reimbursement of the delivery costs. Given the nature of the goods, repeated delivery cannot be guaranteed for chilled foodstuffs.
- The Buyer is advised to inspect the consignment upon receipt and to notify the Seller without undue delay of any visible damage to the packaging or any breach of the cold chain.
6. Withdrawal from the Contract
The conditions and exceptions that apply to chilled foodstuffs are described on the separate page Withdrawal from the Contract, including the model form. It forms an integral part of these terms and conditions.
7. Rights Arising from Defective Performance
The Buyer's rights arising from defective performance and the procedure for making a complaint are governed by the Complaints Procedure, which forms an integral part of these terms and conditions.
8. Discount Codes and Loyalty Points
- Discount codes are valid for the period and under the conditions stated for the specific promotion; they cannot be exchanged for cash and cannot be combined unless stated otherwise.
- For goods purchased (excluding delivery), the Seller credits Buyers who have an account with loyalty points equal to 2% of the price of the goods. Points are credited once the order is completed, are valid for 12 months, are always redeemed by the Buyer personally, and may be used to pay for at most half of the price of the goods. Points cannot be used to pay for delivery.
- In the event of withdrawal from the contract or return of goods, the points credited for the order concerned are deducted; points redeemed in such an order are returned to the Buyer's account.
9. User Account
The Buyer may create an account after placing an order. The Buyer is obliged to protect their login details; the Seller is not liable for damage caused by their disclosure to a third party. The Seller may cancel the account, in particular if the Buyer breaches these terms and conditions.
10. Personal Data Protection
How the Seller handles personal data is described on the Privacy Policy page.
11. Out-of-Court Dispute Resolution
The authority competent for the out-of-court resolution of consumer disputes is the Czech Trade Inspection Authority (Česká obchodní inspekce), Central Inspectorate – ADR Department, Gorazdova 1969/24, 120 00 Praha 2, adr.coi.cz. The same authority supervises compliance with consumer protection regulations; supervision of foodstuffs is carried out by the Czech Agriculture and Food Inspection Authority (Státní zemědělská a potravinářská inspekce).
12. Final Provisions
- Relations not governed by these terms and conditions are governed by the law of the Czech Republic, in particular the Civil Code (Act No. 89/2012 Coll.) and the Consumer Protection Act (Act No. 634/1992 Coll.). This is without prejudice to the consumer's rights arising from the mandatory provisions of the law of the state of their residence.
- If any provision is invalid, the remaining provisions remain in force.
- The Seller may amend these terms and conditions. Each order is governed by the version in effect at the time it is submitted.
- These terms and conditions take effect on the day of their publication.
